Heard Shri Sayajee Jagtap, the learned counsel for the petitioner. 2.
The grievance of the petitioner is that on 24th July, 2025 the respondent no.2-Collector had cancelled Beer Shopee License of the petitioner situated at Kamptee, District Nagpur. 3.
Being aggrieved by the aforesaid cancellation order, the petitioner approached the Commissioner, State Excise, Maharashtra State, Mumbai by filing an appeal on 06.08.2025. The aforesaid appeal was dismissed by the Commissioner, State Excise, M.S., Mumbai, on 29.10.2025.

Being aggrieved by the order dated 29.10.2025 passed by the Commissioner, State Excise, M.S., Mumbai, dismissing the appeal, the petitioner preferred a revision application before the respondent no.1 under Section 138 of the Maharashtra Prohibition Act, 1949. The aforesaid revision application was filed on 11.11.2025, which is at record page no.26 -Annexure P5.

Shri Sayajee Jagtap, the learned counsel for the petitioner submits that after 11.11.2025 the aforesaid revision application has
5-WP-712-2026.odt 2 not been taken up for decision on merits or for any interim order. Accordingly, the petitioner has filed an application for grant of early hearing on 12.01.2026 before the respondent no.1, which is at record page no.40-Annexure-P6. However, even the aforesaid application for grant of early hearing has also not decided as yet. 6.
Since the license of the petitioner's Beer Shopee has been cancelled, the source of livelihood of the petitioner, so also of the employees working in the establishment of the petitioner have been deprived of.

In that view of the matter, we dispose of the present writ petition with a direction to the respondent no.1 to decide the revision application filed by the petitioner on 11.11.2025, which is at record page no.26-Annexure-P5, within a stipulated period of four weeks from the date of receipt of copy of order passed by this Court. 8.
Decision taken on the revision application shall be communicated to the petitioner within a period of two weeks from the date of such decision.

The petitioner undertakes to submit before the respondent no.1 the copy of the order passed by this Court.

With these directions, the writ petition is disposed of. No order as to costs.
