IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR WRIT PETITION NO. 758 OF 2026 Gajanan S/o Rambhau Mapari Vs.

The Chief Executive Officer, Zilla Parishad, Buldhana and others -------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders -------------------------------------------------------------------------------------------------------- Shri S.S. Kulkarni, Advocate for petitioner Ms H.N. Jaipurkar, AGP for respondent/State CORAM :

SMT M.S. JAWALKAR AND NANDESH S. DESHPANDE, JJ.

DATED : 28.01.2026 Leave to amend.

2.

The amendment to be carried out forthwith to incorporate the prayer regarding expeditious disposal of the statutory appeal pending before the Divisional Commissioner, Amravati.

3.

Leave to amend the prayer clause so as to seek a direction for expeditious disposal of the statutory appeal pending before the respondent No.2.

4.

Notice to the respondents, returnable forthwith. 5.

Learned AGP waives for respondent No.2.

6.

In view of the order, we do not think it fit to call for a reply of the respondents.

(2) 908 wp 758-2026 7.

As can be seen from the petition, the statutory appeal pends before the Divisional Commissioner bearing Appeal No. 10/2024.

8.

In that view of the matter, we are of the considered opinion that the grievance of the petitioner would be ventilated if direction is given for expeditious disposal of the said appeal. We therefore direct respondent No.2 to decide the appeal bearing No. 10/2024 within three months from the date of receipt of the order. The petitioner is directed to appear before the Divisional Commissioner on 02.02.2026 and to apprise the said authority of the order of this Court.

9.

The Writ Petition is disposed of.
