The petitioners are aggrieved by a wall compound which has been constructed by the respondent No.3- Shri Santaji Co-operative Housing Society, Nagpur, divided the land of the layout owned and possessed by the present petitioners.

Shri Bhishikar, learned counsel has invited our attention to various representations filed by the petitioners to the Chief Officer, Municipal Council Besa-Pipla, District - Nagpur, which are at record page No. 41 (Annexure 6). The first such representation was submitted on 08.04.2025. Since the aforesaid representations were not decided nor any action was taken upon such representations, the petitioners had issued a legal notice to Prity
2 / 2 125.wp780.2026 the respondent No.2 on 26.12.2025, which is on record at Page No.61 (Annexure 7).

Shri Bhishikar, learned counsel submits that the respondent No.2 neither replied the aforesaid notice nor has initiated any action against the respondent No.3. 5.
In view of above, we dispose of the present writ petition with a direction to respondent No.2 - Chief Officer, Municipal Council, Besa Pipla, District - Nagpur to decide the representations which are on record at page No.41 (Annexure 6) dated 08.04.2025 and onwards, so also to treat the legal notice dated 26.12.2025, which is on record at page No.61 (Annexure 7) as a final representation and to decide the same within a period of eight weeks from the date of receipt of the order of this Court.

The decision taken thereupon shall be communicated to the petitioners within a period of two weeks from the date of decision.

Writ petition is accordingly disposed of.
