Shri. N. S. Rao, learned Assistant Government Pleader, waives service of notice on behalf of respondent/State. 3.

The contention is that the petitioner, who is a journalist by profession and is involved in raising issues of public interest, had submitted the applications under the Right to Information Act, 2005. However, the Public Information Officer did not supply the requested information. Consequently, the petitioner preferred first appeals against those applications. However, the first appeals were also without any result and no information was supplied to the petitioner. Being aggrieved thereby, the petitioner has filed second appeals before the respondent - State Information Commissioner, Bench at Nagpur. The details of appeals mentioned in prayer Clause (1), reads thus: "1) To call for the record and entire case papers in respect of Appeals dated 21/08/2025, 02/08/2025, 02/08/2025, 02/08/2025 and 02/08/2025 (Annexure-3), Appeals dated 25/07/2025, 25/07/2025, 25/07/2025 and 25/07/2025 (Annexure-6), Appeals dated 02/07/2025, 02/08/2025 and 02/08/2025 (Annexure-9), 02/07/2025

118 WP-869-2026 and 02/08/2025 (Annexure-12) filed by the petitioner U/s 19 of the Right to Information Act before respondent - State Information Commissioner, Bench at Nagpur." 4.

Shri. A. A. Dhawas, learned counsel for the petitioner, points out that the statutory period for deciding a second appeal, which is provided under Section 19(6) of the Right to Information Act, 2005, is 30 days, which may be extended up to 45 days. However, the extended period of 45 days is already exceeded and the second appeals are not decided by the respondent.

In view of the above, we dispose of the present writ petition with a direction to respondent - State Information Commissioner, Bench at Nagpur, to decide the appeals as mentioned in prayer Clause (1), within a period of 30 days from the date of production of this order, in accordance with law. 6.

The petitioner undertakes to produce a copy of this order before the respondent within a period of one week from today. The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.
