Shri. C. J. Dhumane, learned counsel, appeared and waived service of notice on behalf of respondent No.1 - Union of India.

The petitioner, Bank of India, has approached this Court seeking a direction to the concerned DRAT, either Mumbai or Chennai, to decide Misc. Appeal [Diary] No.2137 of 2024, registered as Misc. Appeal No.78 of 2025, within a stipulated period.

The contention is that the interim order which was passed by the DRAT on 13.12.2024 is causing prejudice to the Bank and the appeal is not being decided on merits. 5.

Learned counsel for the petitioner has invited our attention to the statutory provisions of the Secularization and Reconstruction of Financial Assets and Enforcement of Security Interest, Act (SARFAESI Act), so also the order passed by the Hon'ble Supreme Court of India in the case of Indian Overseas Bank vs. M/s Radhey Infra Solutions (Pvt.) Ltd. & Ors., wherein

108 WP-911-2026 the Hon'ble Supreme Court observed that such appeals should be decided within stipulated time by the statute. 6.

In view of the above, we dispose of the present writ petition with a direction to the learned DRAT to decide Misc. Appeal No.78 of 2025, within a stipulated period of eight weeks from the date of receipt of this order. 7.

The petitioner undertakes to produce a copy of this order before the learned DRAT.
