D. Chande, Advocate for petitioner.
Ms Kalyani Marpakwar, Assistant Government Pleader for respondent Nos.1 and 2. CORAM : ANIL S. KILOR AND RAJ D. WAKODE, JJ. DATED : 3rd February, 2026 Heard Shri S. D. Chande, learned counsel for the petitioner. The petitioner has approached this Court seeking directions to the respondent No.2-Sub Divisional Officer/Land Acquisition Officer, Nagpur to decide the objection/representation dated 10/12/2025 made by the petitioner which is at Annexure-A (record page No.15) in respect of disbursement of compensation amount in pursuance of the acquired house property bearing Sheet No.164, City Survey No.185. 2.
The contention is that the petitioner is the owner of the aforesaid suit property and the respondent No.3 who is real brother of the petitioner has fraudulently forged the entry in the mutation and is claiming the compensation amount on the basis of the same. Accordingly, the notice under Section 37(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 was issued by the respondent No.2 on 17/11/2025 to the respondent No.3 which is at Annexure-B (record page No.108). Immediately after such notice was issued by respondent No.2 on 17/11/2025, the petitioner has approached respondent No.2-Land Acquisition Officer and has submitted a detail objection dated 10/12/2025. The contention is that the respondent
2 110-WP-977-26.odt No.2 is not deciding the aforesaid objection and is likely to disburse the compensation amount to the respondent No.3. 3.
The learned counsel for the petitioner has invited our attention to the Regular Civil Suit No.367/2025 which is filed by the petitioner against the respondent No.3 pertaining to the mutation in the City Survey record.
4.
In view of the above, we dispose of the present writ petition with a direction to the respondent No.2-Sub Divisional Officer and Land Acquisition Officer, Nagpur to decide the objection dated 10/12/2025 raised by the petitioner as to the entitlement of respondent No.3 for receiving the compensation amount within a stipulated period of six weeks from the date of receipt of the order of this Court.
The petitioner undertakes to produce copy of the order of this Court before the respondent No.2. The decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter.
5.
Writ petition is disposed of accordingly. No costs. (Raj D. Wakode, J.) (Anil S. Kilor, J.) Asmita Signed by: Smt. Asmita A. Bhandakkar Designation: PS To Honourable Judge Date: 04/02/2026 12:05:34
