DATED : 9th February, 2026 Heard Shri Anup Dhore, learned counsel for the petitioners. The petitioner is a minority institution and the certificate dated 15/06/2009 issued by the Competent Authority to that effect is at record page 17 (Annexure-A), however in view of the subsequent change in the policy pursuant to the Government Resolution dated 20/02/2025, the petitioner was required to procure the digital Minority Certificate from the respondent No.1. 2.
In view of the aforesaid policy, the petitioner on 14/10/2025 applied to the respondent No.2-Collector, District Yavatmal for grant of such online digital Minority Certificate which needs to be recommended by respondent No.2-Collector to the respondent No.1. 3.
Shri Anup Dhore, learned counsel submits that the respondent No.2 has not yet forwarded the aforesaid proposal for grant of digital Minority Certificate for recommendation. The respondent No.2 by virtue of communication dated 28/01/2026 has raised certain queries. It is submitted that on 02/02/2026 the petitioner has submitted a
2 155-WP-978-26.odt detail explanation satisfying the aforesaid queries and thus the issue is subjudice before the respondent No.2.

In view of the above, we dispose of the present writ petition with a direction to respondent No.2 to take appropriate decision upon the application dated 14/10/2025 submitted by the petitioner in accordance with the explanation which is submitted by the petitioner on 02/02/2026 and accordingly forward the proposal to the respondent No.1 for grant of digital Minority Certificate. The aforesaid decision shall be taken within a period of four weeks from the date of receipt of the order of this Court. 5.
Shri Anup Dhore, learned counsel for the petitioners has further pointed out that respondent No.2-Collector vide query No.2 has insisted upon the decision of the Assistant Charity Commissioner, Yavatmal i.e. respondent No.3 upon the Change Reports pertaining the petitioner-Management.

In view of the above, we direct the respondent No.3-Assistant Charity Commissioner, Yavatmal to decide the Change Report dated 17/04/2018 vide Inquiry No.215/2018, Change Report No.320/2018 dated 25/07/2018 and Change Report No.276/2023 dated 27/07/2023 within a stipulated period.
No order as to costs.
