Heard the learned counsel for the respective parties. 2.
Mr. Dable, learned counsel for the petitioner, submits that since Interim Application (IA) No. 163 of 2026 is decided on merits, nothing survives for adjudication in this petition. However, he submits that Interim Application (IA) No. 1698 of 2025 seeking appointment of a Chartered Accountant as Commissioner for preparation of list of stock/ inventory lying on mortgaged properties and verification of encroachment on mortgaged properties, is not yet decided. He therefore submits that if the directions are issued to the Debts Recovery Tribunal (DRT), Nagpur to decide the said application and other pending applications filed by the petitioner, the purpose would be served.

Mr. Fuladi, learned counsel for the respondent no.2-Bank has no objection to issue such directions. According to him, the Bank has already filed its reply to the said applications filed by the petitioner before the DRT, Nagpur.

In the circumstances, we dispose of the present writ petition with a direction to the DRT, Nagpur, to decide IA No. 1698 of 2025 and
922-WP-986-2026.odt 2 other pending interim applications within a period of two months from today, after hearing the respective parties.

With these directions, the writ petition is disposed of. No order as to costs.
