By way of the instant petition, the petitioner has challenged the Order dated 05.01.2026 passed below Exh.34 in Special Civil Suit No.1/2024, by the Trial Court thereby, rejecting the application filed by the petitioner/defendant for issuing witness summons to a witness from Shriram Finance Company, Branch Akot. 2.

After arguing the matter for sometime, learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to file a fresh application on behalf of the petitioner/defendant for issuance of witness summons by mentioning necessary particulars of the witness.

Petitioner is permitted to withdraw the petition with liberty to file appropriate application before the Trial Court. Any such application be decided by the Trial Court by considering the position of law in that regard. 4.

In view of above, the writ petition is disposed of as withdrawn with liberty as prayed for.
