Thakkar, learned counsel for the petitioners. The petitioners have approached this Court seeking direction to respondent No.
1-Sub Registrar, Chandrapur to register the Sale Certificate in favour of petitioner No.2. The aforesaid Sale Certificate was issued on 18/12/2025 in pursuance of the proceedings initiated by petitioner No.1 under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The aforesaid Sale Certificate is at record page 22 (Annexure-D). Though the Sale Certificate has been issued in favour of petitioner No.2, the learned counsel for the petitioners Shri Thakkar submits that respondent No.1 is not registering the same inspite of repeated requests made by the petitioners.

The learned counsel submits that there is no interim order passed by the learned Debt Recovery Tribunal, Nagpur prohibiting respondent No.1 from registering such Sale Certificate. Much less, there is no proceeding pending before the DRT, Nagpur in relation to the Sale Certificate in question.

In view of the above, we dispose of the present writ petition with the direction to the respondent No.1 to treat the present writ petition as the representation on behalf of petitioner Nos.1 and 2 for the aforesaid relief of registration of Sale Certificate dated 18/12/2025. The respondent No.1 is directed to decide the aforesaid representation within a period of three weeks from the date of receipt of the order of this Court.

The petitioners undertake to produce copy of the present writ petition alongwith the order passed by this Court before the respondent No.1.

If respondent No.1-Sub Registrar, Chandrapur is of the opinion that such Sale Certificate cannot be registered, he/she shall pass a reasoned order in that regard. If the petitioners are otherwise entitled, the respondent No.1 is directed to register the Sale Certificate dated 18/12/2025 in favour of petitioner No.2. 6.
Writ Petition is disposed of in aforesaid terms. No order as to costs.
