Shri. C. J. Dhumane, learned counsel, appeared and waived service of notice on behalf of respondent No.1 - Union of India. 3.
The contention is that the petitioner - borrower, who approached the learned Debts Recovery Tribunal, Nagpur, by filing S.A. No.259 of 2025, has filed Interim Application No.126 of 2026. The said application is at record page No. 43 (AnnexureD). The aforesaid application was filed on 21.01.2026, after the auction sale was conducted on 14.01.2026.

By way of the aforesaid application, the petitioner has sought permission to deposit the amount under Section 19(25) of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 and for cancellation of sale. Pursuant to the directions of the learned Tribunal, the Bank had filed a pursis on 28.01.2026, thereby pointing out the outstanding amount to be paid by the petitioner. The said pursis is at record page No.48 (Annexure-E). 5.
Learned counsel for the petitioner submits that, in view of the aforesaid pursis, the petitioner, by filing pursis dated 29.01.2026, before the learned Tribunal, which is at record page
114 WP-1105-2026 No.49 (Annexure - F), expressed his readiness to deposit the said amount. However, the learned Tribunal has not yet decided Interim Application No.126 of 2026. Therefore, the petitioner seeks a direction to the Debts Recovery Tribunal, Nagpur, to decide the aforesaid application within a stipulated period. 6.
In view of the innocuous prayer made by the petitioner, we dispose of the present writ petition with a direction to the Debts Recovery Tribunal, Nagpur, to decide Interim Application No.126 of 2026 in S.A. No.259 of 2025, within a stipulated period of two weeks from the date of receipt of this order. 7.
In the meanwhile, the Debts Recovery Tribunal, Nagpur, is directed to take a decision upon the pursis dated 29.01.2026 filed by the petitioner and to decide whether the petitioner is to be permitted to deposit the amount with DRT, Nagpur. 8.
The writ petition is, accordingly, disposed of. 9.
The Office is directed to communicate this order to the learned Debts Recovery Tribunal, Nagpur.
