Learned AGP Ms Hemlata Dhande waives notice for the respondent Nos.1, 2 and 5.

In view of the limited prayer for direction to the respondent No.1-Scheduled Tribe Certificate Scrutiny Committee, Chandrapur to decide the caste claim of the petitioner within a stipulated period, we do not think it necessary to issue notices to other respondents. 4.

It appears that a proposal was submitted by the petitioner on 13/11/2025 to the respondent No.1. The petitioner is claiming to belong to 'Mana' community, which is declared as Scheduled Tribe. He came to be appointed on the post of Electrical Assistant with the respondent No.4KHUNTE

919-wp1153.26.odt 2/2 Executive Engineer, M.S.E.T.C.L., Boisar 220 KV Sub-Center Boisar-2. The petitioner submitted his claim to the respondent No.1-Scrutiny Committee on 13/11/2025, however, till date there is no decision. The petitioner apprehends that nonsubmission of caste validity certificate, his services may be terminated, in view of the conditions mentioned in the appointment order. In view thereof, the petition can be disposed of with direction to the respondent No.1-Scrutiny Committee to decide the caste claim of the petitioner within a stipulated time and also direct the respondent Nos.3 and 4 not to take any coercive steps till the decision of the caste claim of the petitioner. As such, the petition is allowed. 5.

The respondent No.1-Scrutiny Committee is hereby directed to decide the caste claim of the petitioner within a period of eight weeks from the date of production of this order.

The respondent No.3-Chief Engineer, M.S.E.T.C.L. (EHV), (O&M), Washi and respondent No.4-Executive Engineer, M.S.E.T.C.L., Boisar 220 KV Sub-Center Boisar-2, Vidyanagar, Post Sarawali, District Palghar are hereby directed not to take any coercive steps in respect of employment of the petitioner till his caste claim is decided by the respondent No.1-Scrutiny Committee.

The petition stands disposed of in the above terms. No costs.
