The petitioner, who is working as a teacher in respondent No.2 - School, has approached this Court seeking challenge to the report of the Medical Board dated 17th March, 2025. 3.

The Medical Board, after conducting the medical examination of the petitioner, recorded the finding in Column No.2 pertaining to fitness for duty as "Yes". Being aggrieved by the said fitness certificate, the petitioner has challenged the aforesaid report issued by the Medical Board by filing the present writ petition.

It is the contention of the petitioner that she was appointed as a teacher in respondent No.2 - School on 1st December, 2010, and was diagnosed with Chronic Myeloid Leukemia (blood cancer) on 30th March, 2024. During the course of treatment for the said illness, the petitioner has undergone a Stem Cell Transplant.

The petitioner submits that she has been continuously advised by her treating doctors to remain in isolation. In view of the aforesaid condition, respondent No.2 directed the petitioner to submit herself for medical examination before a duly constituted Medical Board of Shri V.N. Government Medical College, Yavatmal.

The said Medical Board, despite being fully aware of the petitioner's illness, as reflected in Column No.1 pertaining to diagnosis, i.e., CML, recorded a finding that the petitioner is fit to resume her duties. The only reason recorded in support of such finding is the single word "Yes".

In view of the above, we dispose of the present writ petition with a direction to respondent No.1 - the Medical Board, Shri V.N. Government Medical College, Yavatmal, to conduct a fresh medical examination of the petitioner. 8.

While doing so, respondent No.1 shall consider all documents pertaining to the petitioner's illness, including her Bone Marrow transplant and the consequential medical advice regarding isolation during the course of treatment. 9.

Respondent No.1 shall assign proper reasons in support of its conclusion. No costs.
