IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 1365 OF 2026 Siddhartha Pushpendrakumar Sharma Vs.

State of Maharashtra & Ors.

______________________________________________________________________________ Office Notes, Office Memoranda of Coram, Appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.

Mr. P.U. Kavishwar, Advocate for the Petitioner. Mr. I.J. Damle, AGP for Respondent Nos.1 to 6. ------------------------------- CORAM : ANIL S. KILOR AND R AJ D. WAKODE , JJ.

DATE : 12.02.2026 Heard Mr. P.U. Kavishwar, learned counsel for the petitioner.

2.

The petitioner seeks a direction to respondent No.1 to consider the application dated 9th January, 2026 for impleading the petitioner as a party respondent to the revision pending before respondent No.1.

3.

It is the contention of the petitioner that he acquired title to the property bearing Plot No.32 out of Survey No.13/1 of Mouza Umarkhed, Taluka and District Akola (now Nazul Sheet No.66, Plot No.24/99), on 11th April, 2025 from respondent No.7. Mutation Entry No.439 was thereafter effected in the petitioner's name in the record of rights on 21st May, 2025.

4.

Respondent No.8 challenged the title of respondent No. 7 and the mutation entry by filing an appeal under Section

2/3 247 of the Maharashtra Land Revenue Code, 1966 before respondent No.3 - Deputy Director of Land Records, Amravati. The said appeal was dismissed on 13th August, 2025. 5.

Being aggrieved by the dismissal, respondent No.8 filed a revision before respondent No.1 - the Hon'ble Minister of Revenue on 13th November, 2025. A copy of the said revision is at record page No.71 (Annexure-F).

6.

Since the issue involved in the revision pertains to the property owned by the petitioner, the petitioner attempted to file an application for making him as a party respondent in the said revision. However, Mr. Kavishwar, learned counsel for the petitioner, has invited our attention to the statement in the petition that the office staff of respondent No.1 refused to accept the said application. Consequently, on 9th January, 2026, the petitioner sent the application by registered post, which was duly received by the office of respondent No.1. 7.

In the circumstances, the petitioner seeks a direction to respondent No.1 to consider the application dated 9th January, 2026.

8.

In view of the above, we dispose of the present writ petition with a direction to respondent No.1 - the Hon'ble Minister of Revenue to consider and decide the petitioner's application dated 9th January, 2026, which is at record page No.95 (Annexure-H), and thereafter proceed with the revision in accordance with law.

3/3 9.

Respondent No.1 shall decide the aforesaid application dated 9th January, 2026 in accordance with law and after granting the petitioner an opportunity of hearing. 10.

The decision taken on the said application shall be communicated to the petitioner within a period of two weeks from the date of such decision. No costs.
