After arguing the matter for some time, learned Advocate for the petitioner, upon instructions, seeks permission to withdraw the instant petition with liberty to prosecute the application for grant of stay, which is filed by the petitioner in the proceedings bearing Regular Civil Appeal No.42 of 2024.

The petitioner is granted permission to withdraw the instant petition with liberty as prayed for.

It is directed that the petitioner's possession over the suit property may not be disturbed for a period of ten days from today, to enable the petitioner to prosecute the application for stay before the appellate court.

In view of the above, the writ petition is disposed of as withdrawn.
