At the outset, learned counsel for the petitioner seeks leave of this Court to amend the present petition so as to incorporate pleadings regarding the election of the petitioner as Up-Sarpanch of Gram Panchayat Pipla (K), Tahsil Narkhed, District Nagpur.

Permission is granted, subject to deposit costs of Rs.1000/- in the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur, bearing Account No. 129712010001014 and IFSC Code UBIN0812978.

Necessary corrections be carried out forthwith. 5.

The contention is that the petitioner was elected as a member of Gram Pnachayat Pipla (K), Tahsil : Narkhed,

2/3 Dist. : Nagpur. Subsequently, the learned counsel for the petitioner submits that the petitioner was elected as Upsarpanch of the aforesaid Gram Panchayat on 01.01.2024.

Upon complaint of the respondent No.5, the respondent No.2-Additional Collector had initiated proceeding under Section 14(1)(j)(3) of the Maharashta Village Panchayayt Act, 1956 (for short "the Act of 1956"). 7.

After inquiry, the respondent No.2 had disqualified the petitioner vide order dated 18.12.2025 under the provisions of the Act of 1956.

Being aggrieved by the aforesaid disqualification order, the petitioner had approached the respondent No.1 by filing statutory appeal under Section 16(2) of the Act of 1956, on 29.12.2025.

The learned counsel for the petitioner submits that on 23.01.2026 the respondent No.1 had heard the concerned parties in the appeal and had reserved his decision. However, till date the decision has not been yet pronounced by the respondent No.1.

In the meanwhile the respondent No.3-Tahsildar has issued election program for the post of Upsarpanch of the aforesaid Gram Panchayat, which is alleged to be scheduled on 18.02.2026.

In view of the above, the petitioner has approached this court seeking stay of the aforesaid impugned program issued by the respondent No.3.

The fact remains that the challenge of the petitioner to his disqualification is subjudice before the respondent No.1 and hence, in the aforesaid fact, we direct the respondent No.1 to decide the appeal filed by the petitioner within two weeks from the date of the receipt of this order.

In the meanwhile, if the election is conducted by the respondent No.3, which is alleged to be scheduled on 18.02.2026, the aforesaid election shall be subject to the decision in the appeal rendered by the respondent No.1. 14.

Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
