Heard the learned counsel for the petitioner. 2.

The petitioner, who claims to be a social worker, has approached this Court seeking direction to the Committee, constituted upon the complaint of the petitioner, to submit its report to the Commissioner within a stipulated period. 3.

The contention is that the petitioner had raised complaint as to the misutilization of the Government fund by the respondent Nos.5 to 8-Grampanchayats. Taking cognizance of the complaint submitted by the petitioner on 27.10.2025, the respondent No.1 had constituted a Committee of Four Members to inquire into the matter, on 24.11.2025.

The Four Members Committee, which comprises of Government servants, working as Extension Officers with various Gram Panchayats took charge and commenced the

2/3 inquiry proceedings.

In pursuance of the aforesaid constitution of the Committee, the Committee conducted the preliminary inquiry on 09.12.2025 and has also invited the present petitioner to attend such inquiry on 11.12.2025 and 12.12.2025.

Such fact is substantiated by the communication dated 09.12.2025, issued to the petitioner (page 634).

The Committee is conducting the inquiry and even within one month from the constitution of the aforesaid Committee, the petitioner had submitted representation to the Committee on 11.12.2025, to complete the inquiry within stipulated period.

The fact remains that the complaint as alleged by the petitioner is pertaining to Four Gram Panchayats. The period encompasses from 2015 to 2025 i.e. the audit of entire 10 years. The Members of the Committee are government servants, who are already assigned their official duties and apart from that, they are conducting the inquiry as directed by the respondent No.1.

In view of the above, one of the Members of Committee informed the petitioner that considering the scope of the inquiry, the Committee will require some more time for taking decision in the matter. Such communication, informing the petitioner as to the

3/3 difficulties faced by the Committee is at record page 640. 9.

However, the petitioner has directly approached this Court without awaiting the conclusion of the inquiry or the decision of the Committee, seeking a direction to the Committee to complete the aforesaid inquiry within a stipulated period.

The petitioner alleges that the aforesaid Committee has acted in a biased manner, favouring respondent Nos. 5 to 8 - Gram Panchayats. It is worth to mention here that the petitioner has raised allegation of bias against the Members of the Committee without making such Members or Committee as party respondent in the present petition. 11.

In view of the above, for the reasons recorded above, we dismiss the present petition as misconceived, since the petitioner is trying to abuse the process of law, with costs of Rs.25,000/- to be deposited within four weeks from today, in the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur, bearing Account No. 129712010001014 and IFSC Code UBIN0812978.

We strongly deprecate such practice undertaken at the behest of any individual like the petitioner, who seeks to abuse the process of law by filing a misconceived petition.
