The petitioner has approached this Court seeking direction to the responding No.1 Divisional Forest Officer, Gondia to decide the representation dated 14.11.2025 which is at Page 31 (Annexure 5) of the present writ petition. 3.

The learned counsel for the petitioner submits that inspite of reminder on 27.01.2026, the respondent No.1 has done nothing in the matter and hence, the present writ petition is filed.

Perusal of the writ petition reveals that the representation was submitted by the petitioner for removing the encroachment at the behest of the respondent No.2 on 14.11.2025.

However, without waiting for the completion of the procedure for deciding the aforesaid representation, a

116.wp.1557.2026.odt reminder was submitted immediately in next month, i.e., on 27.01.2026, and within one month thereafter, the present writ petition has been filed seeking directions against Respondent No. 1.

The aforesaid dates reveals that the petitioner has not given sufficient time to the respondent No.1 to apply its mind upon such representation and to conduct the necessary inquiry regarding the alleged encroachment, after issuing due notice to respondent No.2 and granting opportunity of hearing to respondent No.2. However, the petitioner has immediately approached this Court seeking direction against the respondent No.1 for early decision.

Thus, when such haste, at the behest of the petitioner, was pointed out by this Court, the learned counsel for the petitioner, upon instructions, seeks permission to withdraw the present writ petition. Permission is granted. 8.

The writ petition stands disposed of, as withdrawn, however, subject to payment of costs of Rs.1000/- (Rupees One Thousand Only) to be deposited with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur, bearing Account No. 129712010001014 and IFSC Code No. UBIN0812978. No order as to costs. Pending applications, if any, also stand disposed of.
