Heard the learned counsel for the petitioner. 2.

The petitioner has approached this Court, seeking direction to the respondent-management to issue appointment order to the petitioner on compassionate ground on the post of Junior Clerk/Sewak or Laboratory Assistant.

The contention is that the father of the petitioner Late Shiekh Abdul Nazeer Ghulam Hussain was working as Assistant Teacher in the respondent No.1-school, managed by respondent No.2-Trust.

The petitioner's father, i.e., Late Shiekh Abdul Nazeer Ghulam Hussain, died in harness on 01.03.2020. In view of the sudden demise of his father, the petitioner's mother, on 13.07.2020, submitted an application on behalf of the petitioner to respondent No.1 seeking appointment

2/3 of the petitioner on compassionate grounds.

The learned counsel for the petitioner submits that since 2020 till date, the aforesaid claim for appointment on the compassionate ground is pending.

In the interregnum, the petitioner has approached the respondent No. 1 and 2 on several occasions so also to the respondent No.3.

Pursuant to the representation made by the petitioner, the respondent No.3 - Education Officer (Secondary), by communication dated 13.10.2025, directed respondent No.1 to consider and decide the petitioner's claim for appointment on compassionate grounds in accordance with the provisions of the Government Resolution dated 31.12.2002. However, despite the lapse of nearly six months from the issuance of the said communication, respondent No.1 has failed to take any decision on the petitioner's claim.

In view of the above, we direct the respondent Nos.1 and 2 to decide the application dated 13.07.2020 submitted by the petitioner for appointment on the compassionate grounds within eight weeks from the date of receipt of this order.

The learned counsel for the petitioner undertakes to furnish copy of this order to the respondent Nos. 1 and 2 within one week from today.

The decision taken shall be communicated to the petitioner within two weeks from the date of such decision. Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
