The petitioner, who is a retired employee of the respondent No.4- Shri Shivaji College, has approached this Court seeking direction to the respondents to release the interest on delayed payment of pension, gratuity and all pensionary benefits to the petitioner.

The contention is that the petitioner was retired on 30.11.2013; however, his pensionary benefits were released only between April, 2023 and April, 2024. It is further submitted that there was a delay of more than nine years in Corrected as per order releasing the aforesaid pensionary benefits, which is dated 06.03.2026 attributable to the respondents.

In view of the aforesaid delay, the petitioner on 28.06.2024 has submitted a representation to the respondent No.3-Joint Director, of Higher Education, Amravati Division,
Amravati, claiming interest on delayed payment, which is on record at Page 40 (Annexure E).

On the basis of the aforesaid representation, respondent No.3 had raised certain queries vide communication dated 08.04.2025, which was addressed to the respondent No.4-College.

In compliance of the aforesaid communication dated 08.04.2025, the respondent No.4 had fulfilled the aforesaid queries vide communication dated 21.06.2025. The said communication is on record at Page 45 (Annexure H) 7.
The learned counsel for the petitioner submits that even after compliance of the queries raised by respondent No.3- the Joint Director of Higher Education, Amravati, on 21.06.2025, and despite the lapse of more than eight months thereafter, the respondent No. 3 has not decided the aforesaid representation of the petitioner. It is further submitted that no interest on the delayed payment is received by the petitioner. 8.
In view of the above, we direct the respondent No. 3- Joint Director of Higher Education, Amravati to consider and decide the representation dated 28.06.2024 submitted by the petitioner, which is on record at page 40 (Annexure E).

Respondent No. 3, if has any queries regarding the aforesaid representation/proposal, apart from those raised on 08.04.2025, shall communicate such queries to the
petitioner as well as to the respondent No. 4 within a period of one week from today.

The petitioner so also respondent No.4-College are directed to comply with the aforesaid queries within a period of two weeks from the receipt of the said communication from respondent No.3.

Once the queries are complied with by the petitioner so also by the respondent No.4 -College within a period of two weeks, the respondent No. 3 shall decide the aforesaid representation/proposal dated 28.06.2024, for grant of interest on delayed payment of retirement benefits of the petitioner, within a further period of three weeks from the date of such compliance.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter.

The writ petition stands disposed of, accordingly. No order as to costs. Pending applications, if any, also stand disposed of.
