Shri J.Y. Ghurde, learned Assistant Government Pleader, waives service of notice on behalf of all respondents. 3.

The contention is that the petitioner was granted permission for excavation of minor minerals from the land in question by respondent No.3. The aforesaid permission was for the period from 14th July, 2016 to 31st December, 2019. Accordingly, a lease was executed in favour of the petitioner. As per the lease agreement dated 14th July, 2016, there is a renewal clause provided under Chapter 8 of the terms and conditions of the lease. The petitioner had applied to respondent No.3 on 1st October, 2019 for renewal of the aforesaid lease. 4.

Shri P.R. Agrawal, learned counsel for the petitioner, submits that till date and even after passage of more than five years, such application is not decided by respondent Nos.2 and 3. He further submits that the issue involved in the present writ petition is identical to the one involved in Writ Petition No.3249 of 2020, decided by this Court on 15th September, 2022. 5.

In view of above, we dispose of the present writ petition with a direction to respondent No.3 to decide the application dated 1st October, 2019, filed by the petitioner for renewal of his lease, which is at record Page No.27 (Annexure-B), within a stipulated period of

2 WP-1609-2026.odt eight weeks from the date of receipt of a copy of this order. The respondent No.3 is directed to decide the aforesaid application in accordance with law and more specifically in view of the judgment dated 15th September, 2022, passed by this Court in Writ Petition No.3249 of 2020.

The petitioner undertakes to produce a copy of this order along with a copy of the aforesaid judgment relied upon by him before respondent No.3, within a period of one week from today. The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.

The petition is accordingly disposed of.
