Heard Shri Chourgade, the learned counsel for the petitioner. 2.

The petitioner has approached this Court seeking directions to the learned District Court, Akot to hear and finally decide Appeal bearing No. MJC/31/2017. The said appeal is at record page No. 11-Annexure-1. The contention is that the appellants therein are intentionally prolonging the aforesaid appeal and hence the petitioner is prejudiced because of the pendency of the aforesaid proceedings filed under Section 72 of the Maharashtra Public Trusts Act, 1950. 3.

In view of above, we dispose of the present writ petition with a liberty to the petitioner to approach the learned District Court, Akot, by filing appropriate application pointing out prejudice suffered by her and praying for early hearing of the aforesaid proceedings. 4.

If such application is filed by the petitioner, the learned District Judge, Akot, is directed to consider the same on its own merits and in accordance with law.
