The contention is that the petitioners are the owners of agricultural land admeasuring 0.28 HR, which was acquired pursuant to the notice dated 28th February, 2018. 3.

Mr. Thakkar, learned counsel for the petitioners, has invited our attention to the notice at record page No.12 (Annexure-A) issued by respondent No.3, pointing out that the valuation of the acquired land was Rs.10,54,145/-. However, when the award was passed on 6th May, 2022, the petitioners were awarded compensation of Rs.5,14,738/-. He, therefore, submits that the acquiring body has granted only half of the compensation amount to the petitioners as per the valuation report. In view of the said difference, the petitioners had approached respondent No.3 seeking payment of the balance compensation.

The representation dated 30th June, 2022 is at record page No.27 (Annexure-C). Mr. Thakkar, learned counsel for the petitioners, submits that despite the passage of almost four years, respondent No.3 has neither decided the said representation nor modified the award.

In view of the above, we dispose of the present writ petition with a direction to respondent No.3 to decide the aforesaid representation dated 30th June, 2022 within a stipulated period of eight weeks from the date of receipt of this order.

Respondent No.3 is further directed to treat the present writ petition as a representation, in addition to the representation dated 30th June, 2022, and decide the same in accordance with law and the grounds raised in the present writ petition.

If, upon such decision, respondent No.3 comes to the conclusion that the petitioners are entitled to additional compensation, the same shall be paid to the petitioners within a further period of twelve weeks from the date of such decision. 8.

The decision taken thereupon shall be communicated to the petitioners within a period of two weeks from the date of such decision.
