The present petition seeks a direction to the respondent to decide a representation made by the petitioners on 08.12.2025 in accordance with the observations and directions given by the Divisional Commissioner, Amravati, in its order dated 24.12.2024, in a time bound manner.

In view of the order we are proposing to pass we do not think it necessary to call for the reply of the respondent. 7.

The facts which are more or less undisputed are that the petitioner No.1 came to be appointed on 26.11.2008 on the post of Junior Assistant (Accounts) and the petitioner No.2 was appointed

909 wp 1827-2026.odt 3/4 on the said post on 01.01.2009. The petition further states for promotion to the post of Senior Assistant (Accounts), it is necessary that the employee must pass the inter departmental examination within due period of time as well in specific number of chances. Thereafter, even though the petitioners were eligible employees junior to them were promoted by order dated 22.07.2023. 8.

Being aggrieved by this promotion orders, the petitioners filed an appeal under Rule 14 of the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules, before the Divisional Commissioner, Amravati. On 24.12.2025. While deciding the said appeal, the Divisional Commissioner, Amravati, directed the Zilla Parishad to consider the case of the petitioner for grant of deemed date as per the Government Resolution dated 06.06.2022. It is the contention of the petitioners that in spite of the said order of the Divisional Commissioner, no steps have been taken. This constrained the petitioner to file a representation with the respondent on 08.12.2025. This according to the petitioners has not been decided as yet, and therefore, the present petition for seeking a directions for the time bound disposal of the said representation.

In that view of the matter, the petition is partly allowed. 10.

We direct the respondent to act upon the representation preferred by the petitioners and pending before it, in light of the order of the Divisional Commissioner, passed on 24.12.2024 within six weeks from the date of this order.

The writ petition is disposed of as such.
