Learned counsel for the petitioner, on instructions from his client, makes a statement that the written statement dated 13.03.2024 filed on behalf of the petitioner/defendant No.3 i.e Gautam S/o. Shriram Kamble, which was marked as Exh-"A" before the Trial Court (Annexure J-3 to the instant petition) be considered to be the written statement of defendant No.3 in the civil suit.

In view of this statement, learned counsel for the petitioner does not press for the application dated 02.08.2025 at Exh.139 on which the impugned order dated 30.08.2025 was passed.

In view of this, learned counsel for the respondent/original plaintiff submits that the written statement filed on 13.03.2024 at Exh.-"A" will only be taken into consideration for the purpose of contesting the suit.

Considering the statement made by the learned counsel for the petitioner, on instructions referred above, the grievance against the impugned order dated 30.08.2025 does not survive and accordingly, the writ petition is disposed of. However, considering the nature of controversy and the fact that the suit is of the year 2010, the trial Court is directed to expeditiously decide the civil suit preferably within a period of six months from today. 5.

Parties are directed to co-operate the trial Court for expeditious decision of the suit without seeking unnecessary adjournments.
