The present petition seeks consideration of the petitioner's candidature for admission to the M.D. Pathology course in institutional round, as three vacancies are available.

The prayer of the petitioner has been strongly opposed by respondent No.5.

Shri Gaikwad, learned Counsel for respondent No. 5, has pointed out that the petitioner was allotted a seat in the M.D. Pathology branch at Ashwini Rural Medical College, Solapur, however, she failed to join the same. 4.

Mrs. Deshpande, learned Counsel for petitioner tried to justify it and states that she could not join because of some family problems which were beyond her control. She further submits that since the vacancies are there, she could be considered.

Having gone through the Information Brochure, particularly the provisions relating to the availability of seats for the Online CAP Stray Vacancy Round, it is evident that candidates who have joined a seat in Round-1 or Round-2, or have been allotted a seat in Round-3, including those under the All India Quota, are not eligible to participate in any further rounds, even if seats remain vacant.

In the present matter, the petitioner was allotted a post-graduate seat in the M.D. Pathology branch in the aforesaid college, however, she failed to join the same. Consequently, she falls within the category of candidates who are not eligible to participate in further rounds. 7.

In light of the said specific provision and as nothing is pointed out by the petitioner to show that the petitioner is having right after such denial to joint the seat allotted to the petitioner, to claim a vacant seat in further rounds, we do not find any reason to interfere in the admission process or to grant the reliefs as sought in the present petition. Accordingly, the petition is dismissed.
