Issue notice to the respondents.

Ms. D.I. Charlewar, learned Assistant Government Pleader waives service of notice on behalf of respondent No.1. 4.

In view of the order being passed, notices to the respondent Nos.2 and 3 are dispensed with.

As can be seen from the averments made in the petition that the petitioner was appointed as Block Community Mobiliser by District Mother and Child Care Officer, Zilla Parishad, Wardha on contractual basis on 12.4.2013.

On 6.8.2025, the wife of the petitioner committed suicide and the Karanja Police Station, District Wardha, registered an offence punishable under Section 108 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, vide Crime No.0532/2025 against the petitioner in which he was arrested on 6.8.2025. On 18.8.2025, the petitioner filed an application for regular bail before the District and Sessions Judge, Wardha and accordingly the said Court granted bail to the petitioner on 3rd September, 2025. However, the respondent No.2 terminated the services of the

J-wp1912.26.odt 3/4 petitioner on 2nd September, 2025. On 19.1.2026, the petitioner submitted a representation to the respondent Nos.2 and 3 requesting for his reappointment. It was followed by a legal notice on 2.2.2026. However, as submitted by the learned counsel for the petitioner that no action has been taken on the said representation. 7.

We have heard Mr. S.I. Khan, learned counsel for the petitioner. Even though the petitioner prays for quashing and setting aside the order of the 2nd September, 2025, in our considered opinion, the interest of justice would serve, if the respondent No.2 is directed to decide the representation in accordance with law. The said representation/appeal is filed on 19.1.2026 and is pending till date.

In that view of the matter, we dispose of the petition with a direction to the respondent No.2 to decide the representation dated 19.1.2026 followed by legal notice on 2.2.2026 within four weeks from the date when the petitioner appears before the respondent No.2.

The petitioner is directed to appear before the respondent No.2 on 13th March, 2026 and comply with the further directions of the said Authority.

Needless to mention that the respondent No.2 to decide the said representation in accordance with law after granting

The petition is disposed of.
