Learned advocate for the petitioner, on instructions from the petitioner, seeks to withdraw the petition with liberty to avail alternate remedy of filing appeal under Section 247 of the Maharashtra Land Revenue Code.

The petition is disposed of as withdrawn with liberty as prayed.

The period spent in prosecuting the present petition will be excluded for the purpose of computation of limitation in filing appeal. All points raised are kept open.

In the event the appeal is filed, the Appellate Authority shall make an endeavor to decide the same as expeditiously as possible and, in any case, the interim application for release of vehicle shall be decided within a period of two months from the date of filing of appeal.
