Heard the learned counsel for the respective parties. 2.

The present petition is filed for direction to the respondents to apply old pension scheme to the petitioner. The contention of the petitioner that his father was working with the respondent No.4-Municipal Council, Tumsar, District Bhandara as a Peon and expired on 15/02/2001. 3.

The petitioner filed an application for appointment on compassionate ground on 01/03/2001. After compliance of the documents, he again made representation to the respondent No.4. Ultimately, he came to be appointed on 15/01/2018 on compassionate ground. It is his contention that in view of representation filed in the year 2001, the petitioner is eligible and entitled for the benefit of pension provided under the Maharashtra Civil Services (Pension) Rules, 1982.

The learned AGP submits that since the petitioner came to be appointed in the year 2018, he is not entitled for the old pension scheme. She further submits that as per GR dated 31/10/2005, the cut-off date for granting old pension scheme is 01/11/2005.

In view of above and as the present petitioner is appointed in the year 2018, there is no question of any application of old pension scheme to the petitioner. As such, the petition is devoid of merits and accordinlgy, it is dismissed. No costs.
