The petitioner - Bank, a secured creditor, has initiated action against respondent Nos.2 to 8, after they committed default in repayment of a loan amounting to Rs.8.13 crores. The petitioner - Bank has approached the learned Debt Recovery Tribunal, Nagpur, and filed O.A. No.325 of 2022, which is still pending before the learned DRT.

On 06.09.2024, the petitioner - Bank filed I.A. No.1665 of 2024, which is at record page No.68 (Annexure-B), seeking attachment of the properties of respondent No.6 before judgment in the aforesaid O.A. However, the said I.A., filed on 06.09.2024, has not yet been decided by the learned DRT. 4.

Section 17(5) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 prescribes a time limit of 60 days for deciding such applications. The proviso thereto permits an extension, which shall not exceed four months from the date of filing of the application.

In view of the aforesaid statutory provision and the urgency pointed out by learned counsel for the petitioner, we dispose of the present writ petition with a direction to the learned Debt Recovery Tribunal, Nagpur, to decide the aforesaid application, being I.A. No.1665 of 2024, within a period of four weeks from the date of this order.

The petitioner - Bank undertakes to produce a copy of this order before the learned DRT within a period of one week from today.

The present writ petition is, accordingly, disposed of. No costs.
