The petitioner has approached this Court seeking a direction to the respondents to take steps for releasing the pension of the petitioner from the date of his retirement so also to release the gratuity and other retiral benefits. 3.

The contention is that the petitioner, who was appointed on 10.01.1992 on the establishment of respondent No.1, applied for voluntary retirement which was granted by the respondent No.1 vide order dated 29.04.2024 and accordingly, he was relieved from the services on 30.04.2024. However, no action was taken by the respondents for preparing the pension case of the petitioner and consequently neither the pension is sanctioned or released nor the retiral benefits are granted. 4.

The learned counsel for petitioner has invited our attention to the communication dated 16.05.2025 issued by respondent No.5 - District Women and Child Development Officer, Akola, to respondent No.4 - Superintendent, Women's State Home, Akola, thereby directing respondent No.4 to submit

103 WP-2060-2026 the pensionary case of the petitioner expeditiously within a period of eight days from the date of the said communication and to ensure that there is no delay in processing the pensionary case of the petitioner. The communication dated 16.05.2025, issued by respondent No.5, is at record page No.73 (Annexure - 14).

However, even after such communication issued by respondent No.5, no steps were taken at the behest of respondent No.4 to prepare the pension case of the petitioner and hence, this writ petition.

A perusal of the petition reveals that the respondents, more particularly respondent No.4, have not come up with any reason for non-processing of the pension case of the petitioner. The petitioner was retired in April, 2024 and now it is almost two years, that the petitioner is without any pension or any salary.

In view of the above, we dispose of the present writ petition with a direction to the respondents, more specifically respondent No.4, to process the pension case of the petitioner and decide the same in accordance with law within a period of six weeks from the date of production of the order of this Court. The decision taken thereupon shall be communicated to the petitioner within two weeks from the date of such decision. 8.
