The petitioner has approached this Court seeking direction to the learned Debt Recovery Tribunal, Nagpur, to decide Misc. Application No.114 of 2022 for condonation of delay in filing the securitization proceedings under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act (for short, "the Securitization Act"), expeditiously.

The contention is that such miscellaneous application was filed on 1st December, 2022 and till date, it has not been decided by the learned Debt Recovery Tribunal, Nagpur. The Securitization Act, vide its Section 17(5), specifically mandates that any application made under sub-section (1) shall be dealt with by the Debt Recovery Tribunal as expeditiously as possible and disposed it within a period of 60 days from the date of such application and the time can be extended as per the proviso upto a maximum period of four months. However, the above miscellaneous application for condonation of delay in filing the securitization proceedings is pending with the learned Debt Recovery Tribunal, Nagpur, for more than three years.

In view of the above, we dispose of the present writ petition with a direction to the Debt Recovery Tribunal, Nagpur, to decide the aforesaid Misc. Application No.114 of 2022 expeditiously considering the provisions of law.
