The learned counsel for the petitioners raised a grievance that during the pendency of the Appeal (Diary) No. 2438 of 2026, in relation to the first auction, before the Debt Recovery Appellate Tribunal, Mumbai (for short 'the DRAT, Mumbai'), the second auction notice is being issued. 3.

In the circumstances, the learned counsel for the petitioners insists for direction to the DRAT, Mumbai to decide the appeal at the earliest. Since, the prayer is innocuous, we are of the opinion that, no prejudice will be caused to any of the respondents if the request made by the petitioners is accepted.

Accordingly, we direct the DRAT, Mumbai to decide the Appeal (Diary) No. 2438 of 2026, which is pending for hearing, within four weeks from the next fixed date i.e. 09.04.2026.

We further direct the Debt Recovery Tribunal, Nagpur to consider the application filed by the petitioners for stay on next date i.e. on 09.04.2026.

The writ petition stands disposed of, in the above terms. Pending applications, if any, also stand disposed of. No order as to costs.
