DATE : 13-03-2026.
Heard learned Counsel for the petitioner.
2.
The contention of the petitioner is that, despite the fact that his name is recorded as the owner in the revenue record by way of mutation entry and that he has been regularly paying municipal taxes, the land belonging to the petitioner was acquired and while passing the award, Respondent No. 3 - the Special Land Acquisition Officer and SubDivisional Officer, Nagpur - failed to recognize the petitioner as the recorded owner. The award neither refers to the petitioner's name as the owner nor acknowledges his entitlement; instead, the award has been passed in the name of the previous owner and the compensation has also been deposited accordingly. The petitioner had immediately approached respondent no.3 by filing representation dated 01-12-2025 to respondent no.3, thereby pointing out the aforesaid anamoly the award. Such representation was submitted on 01-12-2025. The petitioner has also filed a reference on 29-12-2025 which is on record at page no.35 at Annexure
7. Learned Counsel for the petitioner submits that respondent no.3 has neither decided the aforesaid representation dated 01-12-2025 nor has made reference in view of the aforesaid the application dated 29-12-2025.
2 wp 2220.26.odt 3.
In view of the above, we dispose of the present writ petition with a direction to respondent no.3 to decide the representation dated 01-12-2025 and application dated 29-12-2025 submitted by the petitioner within a stipulated period of six weeks from the date of production of order of this Court.
4.
The decision taken thereupon shall be communicated to the petitioner within two weeks from the date of decision. 5.
Writ petition is disposed of accordingly.
