Heard the learned counsel for the petitioner. 2.

The petitioner seeks challenge to the withdrawal of benefits of incentives from August-2019 for acquiring Ph.D. The contention is that Respondent No. 3 - the Registrar of Rashtrasant Tukdoji Maharaj Nagpur University, without issuing any communication or assigning reasons as to why the petitioner is not entitled to the said benefit, has taken the impugned action. 3.

The petitioner has approached the respondent No.2Joint Director of Higher Education, Nagpur Division with similar relief of granting 7th pay fixation with three increments on 22.05.2019 (page 280).

The learned counsel for the petitioner submits that such representation is not yet decided by the respondent No.2.

In view of the above, and the grievance raised by the nd.thawre

2/2 petitioner, we dispose of the present writ petition with direction to the respondent No.2 to decide the representation of the petitioner, dated 22.05.2019, within stipulated period of eight weeks from the date of receipt of this order.

The respondent No.2 is further directed to treat the present petition as a representation and decide the same in accordance with law, on its own merit.

The respondent No.2 is further directed to consider the Order passed by this Court on 10.12.2024, in Writ Petition No.67 of 2023 (Dr. Anil Anand Sargar and another Vs. The State of Maharashtra and others). 8.

The respondent No.2 is further directed to grant an opportunity of hearing to the petitioner, if required. 9.

The learned counsel for the petitioner undertakes to furnish copy of this order along with copy of the present petition as well as the above referred judgment, to the respondent No.2 within one week from today.

The decision taken shall be communicated to the petitioner within two weeks from the date of such decision. Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
