Heard the learned counsel for the petitioners. 2.

The petitioners have approached this Court seeking direction to the respondents not to permit any construction on the land earmarked as playground/open space. 3.

The learned counsel for the petitioners also points out that the communication dated 17.10.2025 sanctioning a financial estimate of Rs.10,00,000/- issued by the respondent No.2 for the construction of compound wall on the aforesaid land which is unsustainable in the eye of law. 4.

However, a perusal of the petition reveals that the petitioners have raised all such grounds, pointing out the illegality in the allotment of funds and the construction on the land reserved as a playground, before the respondent authorities, and more particularly before respondent No.2 - the District Collector, Amravati, by submitting a detailed

2/3 representation dated 04.03.2026, which is placed on record at page 17 (Annexure-III).

The learned counsel for the petitioners submits that though the representation submitted to the respondentauthorities, they have neither acted upon nor decided the same. On the contrary, the construction work is being continued as evident from the photographs, which are at record pages 21 to 26.

Accordingly, we direct the respondents, more particularly respondent No.2 - the District Collector, Amravati, to decide the aforesaid representation dated 04.03.2026 within a period of four weeks from the date of receipt of this order.

The respondent No.2 is further directed to take a decision, within one week from the date of production of this order, as to whether the alleged construction on the playground shall be permitted to continue pending decision on the said representation.

The learned counsel for the petitioners undertakes to furnish copy of this order to the respondents within one week from today.

The decision taken shall be communicated to the petitioners within two weeks from the date of such decision.
