DATE : 24.03.2026 After arguing the matter for some time, learned counsel for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to file appropriate application for amendment in the suit to claim appropriate relief in the nature of declaration or otherwise. 2.
Considering the fact that the suit property i.e. four-storey building is already demolished as submitted by the learned counsel for the petitioner, the controversy involved in the instant petition regarding challenge to the orders passed on the temporary injunction application does not survive.

However, considering the request of the learned counsel for the petitioner for grant of liberty to file application for amendment, the same can be considered. 4.
In view of this, petition is permitted to be withdrawn with liberty as prayed for.
