Heard the learned counsel for the petitioners and the learned Addl.G.P. for the respondent/State.

Considering the nature of order that we proposed to be passed, we are not inclined to issue notice to the respondent Nos.4 and 5.

The petitioners, who are labourers, have approached this Court stating that the order dated 04.07.2015 passed by the competent authority under the Minimum Wages Act, 1948 has not yet been complied with. By the said order, the Labour Commissioner, Akola directed respondent Nos. 4 and 5 to pay minimum wages to the petitioners and similarly situated employees. As the order was not complied with within 90 days, the petitioners approached the authority seeking issuance of a recovery warrant for such non-compliance.

The Judicial Magistrate First Class, Court No.1 nd.thawre

2/2 Malkapur on 16.3.2020 has issued warrant to the Collector Buldhana, directing to release of Rs.1,36,09,883/- to be recovered from the respondent Nos.4 and 5. As the said warrant has remained un-executed for six years, the petitioners have approached this Court. Pursuant to the directions of this Court, the learned Addl. G.P. has filed an affidavit in reply on behalf of respondent No. 3 - Tahsildar, Malkapur.

Perusal of the aforesaid affidavit reveals that the respondent No.3 has pointed out the difficulties which were faced by the respondent No.2 in executing such warrant.

Paragraph 10 of the affidavit states that the answering respondent shall comply with the said order and execute the warrant within six months from today.

The aforesaid statement, made on behalf of the respondent No.3-Tahsildar Malkapur on affidavit dated 27.03.2026, is accepted.
