Heard Shri Tejas Kene, learned counsel for the petitioner and Shri N. S. Rao, learned AGP for all the respondents.

Learned counsel for the petitioner invited our attention to the revision filed by the petitioner under Section 138 of the Maharashtra Prohibition Act, 1949 before the respondent No.1.

The aforesaid appeal which was filed on 11/04//2023 is at record Page No.24 (Annexure-F). 4.

Learned counsel for the petitioner submits that it is almost three years now that the aforesaid revision is pending and is not yet decided.

In the aforesaid revision, the petitioner has sought challenge to the order dated 23/03/2023 passed by the respondent No.2 - Commissioner of State Excise, Mumbai.

The respondent No.2 - Commissioner of State Excise, Mumbai, whereby refused to transpose the name of petitioner in the CL-III Licence. Thus, the petitioner has approached this Court seeking direction to the respondent No.1 to decide such revision within stipulated period. 7.

Shri Rao, learned AGP submits that the aforesaid revision shall be decided.

In view of the above and considering the fact that the revision is pending with respondent No.1 since last more than three years, we dispose of the present writ petition with a direction to the respondent No.1 to decide the aforesaid revision at record Page No.24 (Annexure-F) within stipulated period of four weeks from the date of production of order of this Court.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.

Writ petition is accordingly disposed of.
