Contention is that the petitioner is entitled for Old Pension Scheme and the General Provident Fund considering the fact that the advertisement against which the petitioner was appointed was issued before 01/11/2005, the date on which New Defined Contribution Pension Scheme (DCPS) was made applicable.

It is submitted that the Principal of College-respondent No.4 has already submitted such proposal to the respondent No.3-Deputy Director Education, Nagpur Division, Nagpur for grant of such benefit to the petitioner. The aforesaid proposal dated 14/07/2025 is at record page 45 (Annexure-7).

Shri Pawar, learned counsel submits that even after passage of almost ten months now, the aforesaid proposal has not been decided by the respondent No.3.

In view of above, we dispose of the present writ petition with the direction to the respondent No.3-Deputy Director of Education, Nagpur Division, Nagpur to decide the aforesaid proposal dated 14/07/2025 submitted by the respondent No.4-College for grant of Old Pension Scheme and benefits to the petitioner within a stipulated period of eight weeks from the date of production of the order of this in accordance with law. The decision taken thereupon shall be communicated within a period of two weeks from the date of decision. 6.
No costs.
