Heard the learned counsel for the petitioner. 2.
The contention is that the petitioner was allotted land, admeasuring 54,600 sq. meters, comprising plot No.C-3 in Deoli, MIDC, by the respondent No.1-MIDC. 3.
The petitioner in pursuance of such allotment, started his unit and production in the year 2010. However, due the unfortunate circumstances, beyond the control of the petitioner, the petitioner's unit fell sick and thus, there was erosion in the net worth and the petitioner accumulated the loss. In view of the aforesaid loss, the petitioner's unit was closed in the year 2013. 4.
On 20.08.2020, the petitioner entered into a Memorandum of Understanding with respondent No.4, M/s. SMW Ispat Private Limited, whereby the parties mutually agreed to transfer the aforesaid land along with the building situated on Plot No. C-3 in favour of
2/3 respondent No.4.

In view of the said Memorandum of Understanding, the petitioner on 04.12.2025, submitted application to the respondent No.1-MIDC Mumbai, to grant permission for such transfer. The aforesaid application is at record Page 103, Annexure-K.

The learned counsel for the petitioner invites our attention to the note-sheet (Page 109), which reveals that an entry dated 06.02.2026 records that the said application is liable to be rejected.

Aggrieved by such adverse findings against the present petitioner, the petitioner has approached this Court, seeking direction to the MIDC to grant permission. However, the fact remains that the competent authority has not yet rejected the petitioner's application dated 04.12.2025, seeking permission for such transfer. The petitioner is aggrieved by the note-sheet, which is in the file of the respondent-MIDC.

In view of the above, we dispose of the present petition with direction to the respondent No.1-MIDC, Mumbai to decide the aforesaid application dated 04.12.2025 for grant of permission to the petitioner to transfer the plot No.C-3, admeasuring 54,600 sq. meters, situated in Deoli Growth Centre, MIDC Deoli to the respondent No.4 within a stipulated period of four weeks from the date of receipt of this order.

The respondent No.1-MIDC is further directed to grant opportunity of hearing to the petitioner so also the necessary parties before arriving at such decision. 10.
The respondent No.1-MIDC is also directed to consider the grounds raised by the petitioner in the present petition, for substantiating his claim for grant of permission for such transfer, and to decide the aforesaid application in accordance with law and on its own merits.

The learned counsel for the petitioner undertakes to furnish copy of this order to the respondent No.1 within one week from today.

The decision taken shall be communicated to the petitioner within two weeks from the date of such decision. Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
