Heard learned counsel for the petitioner.

The petitioner is seeking direction of this Court to the respondents to the grant benefit of old pension scheme under the provisions of the Maharashtra Civil Services (Pension) Rules, 1982. The petitioner relies upon the Government Resolution dated 2nd February 2024, which is at record page No.19 Annexure-B and submits that the case of the petitioner is covered by the aforesaid Government Resolution. 3.

The perusal of the petition reveals that the petitioner had already approached respondents by submitting a detailed representation on 29th July 2024, which is at record page No.21 Annexure-C.

Mr. Ingole, learned counsel for the petitioner submits that even after passage of almost two years, the aforesaid MJ Jadhav

2/2 7-WP-2892-2026.odt representation has not yet been decided by the respondents and hence, the petitioner has approached this Court. 5.

In view of the above, we dispose of the present writ petition with a direction to respondent No.3- Additional Director General of Police and Inspector General of Prisons and Correctional Service, Maharashtra, Pune to consider and decide the aforesaid representation dated 29th July 2024 on its own merits and in accordance with law and more particularly in light of the Government Resolution dated 2nd February 2024, relied upon by the petitioner, within a stipulated period of eight weeks from the date of production of order of this Court. 6.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter. 7.

With these observation, Writ Petition is accordingly disposed of.
