Heard Shri Rajeet Bhuibhar, the learned counsel for the petitioner.

The contention is that the petitioner is running a CL-III License bearing No.3/1997 in the name and style 'M/s. M. S. Deshi Bar at Shop No.21(A), Pandurang Bhawan, N. G. Acharya Marg, Chembur, Mumbai-400 071. The petitioner seeks to transfer the aforesaid license to Gat No.132/2 at Chinchoni Botoni, Panchayat Samiti, Maregaon, Tq. Maregaon, District Yavatmal, the reason being that the petitioner is suffering losses in the said business at the aforesaid premises, so also his landlord has directed him to vacate the premises immediately. 3.

In the aforesaid backdrop, the petitioner on 02.02.2026 has applied to the respondent no.3-Collector, State Excise for Mumbai SubUrban, Mumbai, for permission to shift the aforesaid CL-III license. The aforesaid application dated 02.02.2026 is at record page No. 19Annexure-B. 4.

Shri Bhuibhar, the learned counsel for the petitioner, submits that though as per provisions of Rule 25 of the Maharashtra Country Liquor Rules, 1973, the respondents are bound to process the aforesaid

152-WP-3041-2026.odt 2 application, however, till date the aforesaid application is not yet decided.

In view of above, we dispose of the present writ petition with a direction to the respondent Nos. 2, 3 and 4 to process the aforesaid application dated 02.02.2026, which is at record page No.19Annexure-B, within a stipulated period of six weeks from the date of production of copy of order of this Court. Once such application is processed, the respondent no. 1-State of Maharashtra through its Secretary, Department of State Excise, is directed to decide the aforesaid application within a period of four weeks from the date of submission of the record by the respondents in pursuance of the application dated 02.02.2026.

Decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision. 7.

With these directions, the writ petition is disposed of. No order as to costs.
