Heard learned Senior Advocate for the petitioner. 2.

Petitioner's challenge is to the order dated 02.03.2026 and 06.04.2026 passed by the District Court, Nagpur in proceedings under Section 34 of the Arbitration and Conciliation Act, 1996, in which the petitioner has challenged the Award dated 31.01.2024 passed by the Member, Secretary, Micro and Small Enterprises Facilitation Council and Deputy Director of Industries, Nagpur Region, Nagpur.

Learned Senior Advocate for the petitioner submits that although the petitioner has grievance against the order dated 02.03.2026, it has sought for time to comply the said order. It is submitted that the petitioner's application for extension of time to deposit the amount as per order dated 02.03.2026 ought to have been allowed by considering the reasons mentioned in the application which were bonafide and necessitated extension of time.

In view of the controversy involved, issue notice for final disposal of the petition to the respondent, returnable on 20.04.2026 5.

Petitioner is permitted to serve the respondent by private mode, in addition to regular mode of service, including service upon the learned Advocate appearing on behalf of the respondent/s before the Trial Court, and file affidavit of service before the next date.

Having regard to the controversy involved, in view of deposit of part of the amount by petitioner and in view of the its earlier application (at Exh.18) seeking extension of time to comply the order dated 02.03.2026, it is directed that the execution proceedings shall remain stayed, till next date.
