The contention of the petitioner is that the delay in filing the appeal under Section 247 of the Maharashtra Land Revenue Code, 1966, challenging the order passed by the Sub-Divisional Officer refusing to correct the measurement of the agricultural land owned by the petitioner, was earlier rejected by the competent authority. However, this Court, vide order dated 19th January, 2026 passed in Writ Petition No.1048/2025, has condoned the aforesaid delay, and since then the appeal is pending for decision on merits. 3.

Mr. Kale, learned counsel for the petitioner, submits that even after the passage of considerable time, i.e., more than three months, the aforesaid appeal is not yet decided by respondent No.1 - Divisional Commissioner. Hence, he seeks a direction to respondent No.1 to decide the aforesaid appeal within a stipulated period.

Mr. Ukey, learned Additional Government Pleader appearing for the respondents, submits that the aforesaid appeal shall be decided on its own merits and in accordance with law within a stipulated period, as may be directed by this Court. 5.

In view of the above, we dispose of the present writ petition with a direction to respondent No.1 - Divisional Commissioner, Nagpur, to decide the appeal in question preferred by the petitioner within a period of eight weeks from the date of production of this order.

The decision taken thereupon shall be communicated to the petitioner within two weeks from the date of such decision. 7.
