The petitioners are challenging the communication issued by the respondent No.2 dated 07.04.2026, by which the examination center of the present petitioners is changed and they are directed to appear for the examination at Takshshila Polytechnic College at Amravati, which is at a distance of 46 Km from Darapur.

Heard learned counsel for the petitioners, who submitted that the respondent No.1 under whom all the technical and higher education authorities are created and established to impart the technical and higher education to the students in the State of Maharashtra. The petitioners are the students taking education in respondent No.6 polytechnic institute. There are in all 413 students taking education in different trades. From the last one year the students have noticed some unrest between the teaching and non-teaching staff working in the respondent No.6 polytechnic and the

The students were suddenly communicated by e-mail dated 13.04.2026, by which also the students were directed to appear for the practical examination at Takshshila Polytechnic College at Amravati. He has also invited our attention towards the earlier communication of MSBTE wherein it is specifically stated that without making any change in the examination center, the examination be conducted at Darapur only in the respondent No.2 institute. There is also other communication, 02.04.2026 by which also after considering the Committee Report, it was ordered that the examination to be conducted at the respondent No.6 institute.

However, suddenly the communication was issued to the present petitioners to appear for the examination at Amravati in Takshshila Polytechnic College and accordingly, the Hall tickets are also issued to the students. It is contended by the learned counsel for the petitioners that the students are coming from various adjacent villages of Darapur. In a summer season, it would be very difficult for the students to appear for the examination in absence of any suitable conveyance. However, the respondent No.6 has not taken into consideration all these aspects and contrary to their earlier communication, they have issued the Hall tickets and communication, asking all the petitioners to appear for the examination at Amravati without considering the difficulties which are faced by these students. 3.

Learned APP waives notice for 1 and 4.

Issue notice to the respondent Nos.2, 3, 5, and 6. 5.

Petitioners are permitted to serve the respondents by all modes of service and shall file an affidavit of service on record.

In the meantime, the effect and operation of the letter dated 07.04.2026 issued by the respondent No.2 bearing reference No. MSBTE / D-40 / F1 / SE 2026 / 2026 /12, dated 07.04.2026 and the letter dated 07.04.2026, is hereby stayed till the appearance of the respondents.
