Heard learned counsel for the petitioner.

The petitioner has approached this Court for seeking direction to the respondent Nos.2 to 6 to remove the encroachment made by respondent Nos.8 and 9 on the road between survey No. 540 and 542 so also a further direction to respondent No.9 to remove the encroachment made on the Government land behind the plot of the petitioner bearing survey No.541.

However, the perusal of the petition reveals that the petitioner had not raised such grievance to the competent authority i.e., respondent No.5- Assistant Commissioner, Dharampeth Zone No.2, Nagpur Municipal Corporation. MJ Jadhav

In view of the above, we dispose of the present writ petition with a direction to the respondent No.5 to treat this petition as a representation submitted by the petitioner for grant of such reliefs. The respondent No.5 is directed to decide such representation on its own merits and in accordance with law and after granting an opportunity of hearing to all the necessary parties. The decision shall be taken within a period of eight weeks from the date of production of order of this Court. 5.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.

Writ Petition is accordingly disposed of.
