Heard the learned counsel for the petitioner. 2.

The petitioner seeks direction to the respondent No.3-City Survey Officer, Nagpur, to decide the petitioner's application dated 20.12.2024 within a stipulated period.

The contention is that the petitioner had applied to the respondents on 20.12.2024 for demarcation of the land in question along with all the requisite documents. However, the respondent No.3 has raised an objection calling upon the petitioner to submit RL and NIT sanctioned Map.

The learned counsel for the petitioner submits that the respondents are proceeding on the basis that the aforesaid land has been declared surplus in the ULC proceedings, as having vested in the Government. nd.thawre

2/2 However, the fact remains that the land in question is retainable land, owned by the petitioner.

In view of the above, respondent No.3 - City Survey Officer, Nagpur, is directed to decide the aforesaid application dated 20.12.2024, in accordance with law and on its own merits, particularly in view of the contention raised by the petitioner regarding the nature of the land in question, within eight weeks from the date of receipt of this order.

The learned counsel for the petitioner/s undertakes to furnish copy of this order to the respondent No. 3 within one week from today.

The decision taken shall be communicated to the petitioner/s within two weeks from the date of such decision.

Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
