At the outset, Shri U.K. Bisen, learned counsel for the petitioner, submits that at this moment the petitioner does not want to press prayer clause (a) of this petition, because the petitioner has already approached the respondent No.2- District Collector, Chandrapur by submitting an objection pointing out illegality in the appointment of the respondent No.4.

Shri Bisen, learned counsel, submits that such objection submitted by the petitioner is not yet decided by the respondent No.2- District Collector, Chandrapur and therefore, prays that the respondent No.2 be directed to decide the same within a stipulated period. Such objection is dated 14th January, 2025 and is at record page no.78 (Annexure-8). 3.
Since sufficient time has elapsed and the objection pertains to the election, the respondent No.2- District Collector, Chandrapur is directed to decide the aforesaid objection submitted by the petitioner on its own merits and in accordance with law within a stipulated period of four weeks from the production of the order of this order. The decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter.

Needless to mention that this Court has not observed anything on the merits of the matter and the petitioner shall be at liberty to challenge the decision rendered by the respondent No.2- District Collector, Chandrapur, if it is adverse to the petitioner.
