The petitioners who are Life Insurance Corporation (LIC) agents have approached this Court seeking challenge to the impugned communications dated 13/04/2026 which are at record pages 36 and 37 (Annexure-C).

The contention is that the respondents-Life Insurance Corporation vide aforesaid communications has directed the petitioners to deposit/repay the commission received by the petitioners in pursuance to the insurance policy issued to Chirag Sheth and Payal Sheth. The aforesaid policy holders had a dispute with the LIC and had approached the State Consumer Disputes Redressal Commission, Circuit Bench Nagpur vide Complaint No.SC/CB2/27/CC/8/2021. The Commission passed the order dated 06/01/2026 in favour of the aforesaid policy holders and in pursuance to the decision of the Commission, the LIC has refunded the entire premium amount deposited by the said policy holders.

Now the LIC, in view of the fact that the entire premium amount is refunded to the policy holders and the contract has become null and void as the consideration amount is no more, has directed the present petitioners (agents of LIC) to deposit/repay the commission received by them towards premium received by the LIC from the aforesaid policy holders. 5.

Shri Chitaley, learned counsel submits that the LIC has called upon the present petitioners to deposit the amount which is more than 15 lakh and 20 lakh each, without even granting any opportunity of hearing or calling upon any explanation from them.

This petition was listed before the Court yesterday and the learned counsel for the petitioners was directed to serve the Standing Counsel for the respondents-LIC. As such, Shri Ritesh Badhe, learned counsel appears for the respondents-LIC and fairly submits that the LIC will grant an opportunity of hearing to the petitioners.

In view of aforesaid, the impugned communications dated 13/04/2026 record page Nos.36 and 37 (Annexure-C) are hereby quashed and set aside.

The matter is remanded to the respondent Nos.1 and 2 for decision afresh after granting due opportunity of hearing to the petitioners and passing order in accordance with law on its own merits.
